Dealing with Flawed Arguments

What options do you have in the face of these statements?

Water pricing has changed to encourage people to save water. New prices are on a per household basis:
The first 40 kilolitres of water used each quarter will be charged at 75 cents a kilolitre. Water use between 40 and 80 kilolitres will cost 88 cents a kilolitre and over 80 kilolitres at $1.30 a kilolitre.

What issues are there with this pricing structure?

The next two examples are taken from "An anti-smoking Godzilla stalks the earth" By Michael Scammell, The Age, January 28, 2005.

"If anything - to create a more apt metaphor - the anti-smoking cause is an ascendant public health Godzilla brooking no opposition when it comes to cigarettes and telling people how to behave when it comes to their own wellbeing."

"A sample of this week's media reveals the complete sway anti-smoking campaigners, including Quit, have over the public discourse: one paper reports criticism of the level of cigarette smoking in film and television, another reports on the possibility of banning smoking at outdoor locations such as the beach."
